In the article the evolution of legal regulation of issues, related to the ensuring the safety of ships of the merchant fleet in the Russian Empire in the beginning of XX century is considered. The basis of this process was the examination of all ships irrespective of their classification, toiletries etc. The principal legal documents, on which the process was based, were decree on 23 August 1902 year «On the inspection of vessels, navigating on inland waterways»; the rules of 3 July 1903 year, developed TMiP for passenger ships; on October 1903 year was adopted the draft of rules of inspection ofbarges, lighters and other floating means with no engines or sails; a law of 31 October 1909 year «On amendments to the existing regulations on Maritime trade» (32674); the rules of examination of merchant ships, approved by the Minister of trade and industry on 23 November 1911 year.
